Time for a legal fight against the SAAQ. Are you willing to fight?

Sorry for the English post but my French writing skills are a bit rusty.

I have to agree with most of the comments posted here; we can no longer have the SAAQ take care of our best interests. It is clear that the new licenses fees on Motorcycles (Sports and Touring) no longer make any sense. It is not based on Horsepower, driver riding experience or age. Just a clear indication that the SAAQ has absolutely no clue on what it is doing. It is a clear case of TAX grab and also indicates a completely mismanaged government organization.

So protesting and rallies will have little and/or no effect on changing the minds of the incompetent SAAQ management. So the only way to combat this issue and force the SAAQ into submission or illumination is to do it the legal way in court. It must be shown that the SAAQ is completely incompetent and does not have the ability to properly manage the global no fault insurance funds and force the reprivatisation of the automobile and motorcycle insurance policies as is the case all over the world.


So I suggest the following,

1). Create an online site that all motorcycle members opposed to the SAAQ can register at.
2). Hire a lawyer that will take the class action case to court to plead unfair tax crab and that it is unconstitutional and revokes our right to choose competitive insurance rates and that it unfairly targets motorcyclists.
3). All the registered members on this web site will donate some not for profit financial support (lets say $10 to $20 dollars, still to be determined) to pay for legal fees. Only registered members will be allowed and the names of those who contribute will be posted. This will allow all motorcyclists to see who is willing to help in the fight against the SAAQ and those that are just complainers and do not want to help.
4). Create as much visibility in the public and news media in Quebec on the legal fight against the SAAQ.



So it is time to take the fight legally to the SAAQ. Time for talk is over and time for action is now. I am willing to contribute my time and financial support to this cause and help manage the funds and show accountability for the money spent to all members registered. To legally help in reforming our provincial liability insurance, and to show that the SAAQ is unconstitutional in our right to freely choose our insurance provider and to have healthy market competition.

If there are any lawyers that are motorcyclists, I am willing to meet with you to discuss the above legal case against the SAAQ.

A very noble cause. A class action lawsuit against the SAAQ is already "under consideration" by the CAPM. They already have the legal team and they are checking their financial backing before going foward with it. As you probably know, this is nothing simple to do.

If you are willing to give some time and donation for it, I would suggest you check with them first see if you can merge your efforts. Having two fronts would only split the little support we have.

Je suis d'accord avec les commentaires postés sur le forum, nous ne pouvons plus faire confiance à la SAAQ pour s'occuper de nos meilleurs intérêts. Il est maintenant clair que les nouveaux frais d'immatriculation des motocyclettes(sport et touring) n'ont plus de sens. Ils ne sont pas basés sur la puissance, l'expérience du conducteur ou sur l'âge. Juste une indication claire que la SAAQ n'a aucune idée de ce qu'elle fait. C'est une indication claire d'une taxation et indique qu'elle est devenue une organisation gouvernementale mal dirigée.

Les protestations et rassemblements ont très peu ou pas d'effet sur les décisions administratives incompétentes de la SAAQ. Donc la seule façon de combattre le problème et de forcer la SAAQ à la soumission ou à un changement de cap, c'est d'une façon légale devant la cour. Il doit être démontré que la SAAQ est complètement incompétente et n'a pas les moyens d'administrer les fonds d'assurance (no fault) et forcer la re-privatisation des polices d'assurances d'automobiles et de moto comme c'est le cas partout dans le monde.


Donc je fais les suggestions suivantes:

1) Créer un site en ligne auquel tout les membres motocyclistes peuvent s'enregistrer.
2) Engager un avocat qui s'occupera de mener le cas devant les tribunaux pour plaider une taxe inconstitutionnelle et révoquent notre droit de choisir une assurance compétitive et qui vise injustement les motocyclistes.
3). Tous les membres enregistrés sur ce site donneront un support financier sans but lucratif (disons de 10 à 20$, à déterminer) pour défrayer les frais légaux. Seul les membres enregistrés seront admis et les noms de ceux qui contribuent seront affichés. Ceci permettra à tous les motocyclistes de voir ceux qui aident le combat contre la SAAQ et ceux qui se plaignent et ne veulent pas aider.
4). Créer le plus de visibilité possible pour le publique et les journalistes au Québec sur notre combat contre la SAAQ


C'est le temps de faire face à la SAAQ, le temps des discussions est terminé, il est temps de passer à l'action. Je suis prêt à contribuer de mon temps et argent à cette cause et aider a gérer les fonds et de publier la comptabilité de l'argent dépensé à tous les membres enregistrés Pour aider légalement à réformer notre assurance responsabilité provinciale et pour montrer que la SAAQ est inconstitutionnelle face à notre droit de choisir notre courtier d'assurance et d'avoir un marché compétitif et en santé.

This is my first post on this site but I have been lurking for a few months.

Being a new motorcyclist this summer, I was shocked and bitterly frustrated when I learned of the absurd raise in plating fees from the SAAQ. It is rather discouraging for new riders, like me, to get into this fun sport.

So I'll be following developments here about any legal or class action against the SAAQ and will participate once the time come.

Also, I strongly believe that we elect members to the national assembly so that they can work for us rather than for themselves. Plus, filling up their coffers on our back is NOT the way a government should conduct itself.

If all else fails, when the next election comes around we can talk with our votes and with the amount of motorcyclists in this province...it WILL hurt!

This price hike is nothing new! It was planned years ago and we fought it all along ... when we weren't busy fighting among ourselves or going on vacation or mowing our lawn. We talked with our votes last elections but this is such a non-story for the rest of the population that the candidates were barely aware of it. Let alone took a stance on it or made part of their plans.

I am still waiting to hear from a motorcyclist lawyer who would be interested to discuss how to start leagl process against the SAAQ. I am sure there are motorcyclist lawyers out there. Waiting.......
